Anti Discrimination Board

What is discrimination?

Discrimination in employment occurs when a person is unfairly treated at work. The NSW Anti-Discrimination Act 1977 prohibits discrimination on the following grounds:

• sex (including pregnancy);
• race, colour, ethnic or religious background, descent or nationality;
• marital status;
• disability (including past, present or future physical, intellectual or psychiatric disability, learning disorders or any organism capable of causing a disease - for example, HIV);
• homosexuality;
• age; or
• transgender (that is, anyone who lives, has lived or wants to live as a member of the opposite gender to their birth).

What is harassment?

Harassment is any form of behaviour that is not wanted and not asked for and that:

• humiliates someone;
• offends them; or
• intimidates them.
