When is a complaint not accepted?
- If your complaint is already being investigated by someone else (eg a solicitor, union or another government department)
- If you have lodged an unfair dismissal application, the NSW IR will not investigate your complaint until the unfair dismissal claim has been finalised
- The NSW IR is unlikely to investigate any complaint where allegations of criminal activity remain unresolved
- If your employer is incorporated, they are likely to be covered by the federal industrial relations system. You can complain directly to theĀ Fair Work Online
- If your former employer is in liquidation. You should proceed with your claim through the appointed liquidator, the Workplace Ombudsman or the General Employee Entitlements and Redundancy Scheme.
