What if the complaint is not resolved in the 28-day period?
If your complaint is unresolved at the end of this period and the NSW IR inspector agrees that a genuine attempt at a resolution was made, your employer will be contacted and asked to provide evidence you have received your correct pay and entitlements.
In most cases, you will also be interviewed by the NSW IR inspector and required to produce additional information.
If the NSW IR inspector finds breaches of the award, agreement or NSW industrial relations legislation, your employer may be fined or prosecuted.
N.B. Preparing for court proceedings takes considerable time and you must be willing to attend court as a witness.
