Can the NSW IR investigate my complaint?

Generally, the NSW IR can investigate your complaint when:

  • you meet the NSW IR's assessment guidelines
  • you have tried to resolve the matter with your employer
  • the underpayments relate to work you have undertaken in the last six months
  • your yearly pay does not exceed $100,000 gross
    your employer is unincorporated  (generally a sole trader or partnership) 
  • your complaint relates to non-payment of long service leave.
