Courier May 2009 Audits
Office of Industrial Relations 2008/09 audits under the Courier and Other Delivery Services contract
The investigations will require the following contractors Toll Transport Pty Ltd t/as Toll Fast, Toll Transport Pty Ltd t/as Toll Priority, Hills Express Pty Ltd t/as Hills Transport and Australian Postal Corporation t/as Australia Post to provide the following information to the Office of Industrial Relations by 29 May 2009:

Copies of all registered and unregistered industrial instruments applying to the work being performed by the company and its sub-contractors;

Payroll records for at least 50 employees and 50 sub-contractors in the ten full pay periods prior to 30 April 2009 and payroll records for the same 100 workers in the first four full pay periods prior to 20 December 2008;

Summary details of the number and status of employees and sub-contractors performing work under the contract in the three months prior to 30 April 2009;

A list of all subcontractors engaged to perform work under the contract as at 30 April 2009;

A copy of all filed and operative referral agreements for the conciliation and arbitration of industrial disputes by the NSW Industrial Relations Commission pursuant to section 146A of the Industrial Relations Act 1996 covering the workers performing work under the contract as of 30 April 2009;

(a) Details of any industrial disputes currently underway involving workers performing work under the contract;
(b) Details of any industrial disputes involving workers performing work under the contract in the year to 30 April 2009 -
Details of all arrangements made to provide reasonable access for unions to enter workplaces, subject to State and Commonwealth industrial relations and occupational health and safety laws;

A copy of all workers compensation certificates covering the workers performing work under the contract as at 30 April 2009;

Information demonstrating compliance with the Transport Industry (Mutual Responsibility for Road Safety) (State) Award and the Transport Industry (Mutual Responsibility for Road Safety) (State) Contract Determination, including information about safe driving plans, safety induction (‘blue card’) training and alcohol/drug testing policies;

Information about compliance with the Occupational Health and Safety Act 2000, including details of all safety management plans and occupational health and safety committees;

Details of any lost time accidents recorded by workers performing work under the contract in the year to 30 April 2009; and
-
Details of any sub-contractor known to the head contractor which has failed to remunerate workers performing work under the contract since the commencement of the contract.
If significant breaches of the benchmark conditions are identified in the course of the investigations, additional payroll records may be sought. Preliminary results from the investigations will be published on the Office’s website from June 2009 onwards.
